New Jersey's top prosecutor resigns in the wake of judicial rules against her.
Alina Habba has resigned as the chief federal prosecutor in the state. This follows a court battle that questioned her right to occupy the role.
Official Departure
The nation's top law enforcement official, Pam Bondi, announced her stepping down on the start of the week. Bondi stated that the court's "flawed" ruling made it impossible for her to perform her duties.
"Do not interpret compliance for surrender," Habba stated. "This battle will now stretch across the nation."
Judicial Challenge
Her resignation follows closely on a judicial panel found that she had been unlawfully serving as the federal prosecutor. This decision is likely to affect numerous legal proceedings in New Jersey.
The appellate judges ruled that a interim role that bypassed the advice and consent of the Senate ran afoul of the Federal Vacancies Reform Act.
Ongoing Legal Battle
Bondi said that the former prosecutor will remain at the DOJ as a top consultant. She will pursue additional appeals of the court's action, in the hope of achieving a overturned decision.
